Legal status of marijuana in the state of nebraska
Find out about the legal status of medical and recreational marijuana in the state of Nebraska. Is marijuana illegal? Better safe than sorry!
MEDICAL MARIJUANA IN NEBRASKA
Although there have been attempts to get medical marijuana legalized in Nebraska, the state currently has no medical marijuana program.
The production, sale and possession of any form of medicinal marijuana products are illegal in Nebraska.
RECREATIONAL MARIJUANA IN NEBRASKA
Possession of small amounts of cannabis for personal usage is decriminalized in Nebraska. Possession of up to 1oz (28 grams) is treated as a Infraction and is punished with only a citation and a fine, as long as it is a first offense.
However, the cultivation and sale of cannabis for recreational purposes are illegal in Nevada.
Even though Nevada has decriminalized possession of up to 1oz (28 grams) this doesn't mean you can't get into serious problems for cannabis.
If you get caught for less than 1 oz and its your first offense, it will get you a write up and a fine of $300, but might also mean you will have to take a mandatory course.
Getting caught a second time is seen as a misdemeanor and can already land you in jail for 5 days and get you a fine of up to $500. Getting caught a third time is good for 7 days in jail as well as a fine of up to $500.
Possessing more than 1oz is still seen as a felony, but might get you send to the big house for up to 3 months and get you a fine of up to $500.
More than 1lbs (453 grams) is a felony and get you a whopping jail sentence of up to 5 years.
Selling cannabis is absolutely not tolerated and the sale of even a single joint is a felony and a warranty for some serious jail time.
In the beginning of 2017 an attempt to legalize medical marijuana was made by introducing bill LB 622. Unfortunately the proposal was turned down and as far as we are aware, there are no further plans for possible law changes in the (near) future in the state of Nebraska regarding medical and/or recreational cannabis.
